Terms of Use

  1. Definitions
    1. Activities has the meaning provided to that term in clause 3(g).
    2. Additional Terms has the meaning provided to that in clause 3(g).
    3. Intellectual Property any intellectual property rights, including graphics, copyright, logos, trademarks, distinctive brand features, design, text, icons, the arrangement of them, sound recordings and all software relating to the Website and owned by RAB.
    4. RAB means Radiology Across Borders Pty Ltd
    5. RAB Account means an account created by you on the Website, containing information such as your name, your registration or credential details, your access preferences and history, and contact information.
    6. RAB Privacy Policy means the privacy policy of RAB accessible at https://www.radiologyacrossborders.org/privacy-policy.
    7. RAB Social Media Accounts has the meaning provided to that term in clause 15(a).
    8. Terms of Use means these terms of use.
    9. Website means Our website https://www.radiologyacrossborders.org, and includes the whole or any part of the web pages located on the Website (including but not limited to any elements of design, underlying code, text, sounds, graphics, animated elements or any other content) operated by RAB.
    10. Unsolicited ideas has the meaning given to that term in clause 12.
  2. Website Information
    1. The Website is published by RAB (“Us”, “Our”, “We”, “RAB”).
    2. RAB provides the Website to allow you to interact and communicate with RAB, including but not limited to applying for volunteering or mentoring opportunities with RAB and providing various information, materials, resources or seminars (produced by RAB or third parties).
    3. Your use of the Website, including but not limited to browsing, accessing and using the Website, is subject to the Terms of Use. All the services and products provided directly by RAB or through the Website are governed at a minimum by the Terms of Use, and any other relevant policies and terms and conditions of RAB. If you do not accept the Terms of Use, you must refrain from using the Website.
    4. If you use the Website, you will be deemed to have read, understood and accepted the Terms of Use.
  3. Website Content
    1. RAB may, at any time, add or remove content from the Website without notice.
    2. Any articles, information, content and descriptions published on the Website must be read subject to the Terms of Use.
    3. Although RAB uses its best endeavours to confirm the accuracy of any information published on the Website, you agree that RAB cannot be held responsible for any inaccuracies or errors caused by incorrect information supplied to RAB by a third party in relation to any resources or training material or other content. You agree to make your own enquiries in relation to any of the information provided on the Website and to verify any information provided on the Website.
    4. The information and materials on the Website is provided for general information and educational purposes only. It is current at the time of first publication. It is not legal or other professional advice or intended to be comprehensive, unless specifically stated. To the fullest extent permitted by law, RAB will not be liable for any errors in content, or for any actions you take in reliance on any of the information, materials, resources or seminars produced by third parties. You nor any other person may hold RAB liable for any delays, inaccuracies, errors or omissions in respect of such content, the transmission or delivery of such content or any loss or damage arising from any of them.
    7. RAB may promote or advertise sponsors, functions, events, offers, competitions or other activities which may be conducted online or offline and which may be conducted by, or in conjunction with, other third parties (Activities). These Activities, where possible, will be subject to the Terms of Use. In some situations, these Activities will also be subject to separate terms and conditions (Additional Terms). If you participate in any one or more of the Activities, you will be deemed to have read, understood and accepted the Terms of Use and any relevant Additional Terms.
    8. You participate in the Activities entirely at your own risk. To the fullest extent permitted by law, RAB does not accept any responsibility in connection with your participation in activities conducted by any third party.
  4. Guests and Members
    1. You may access and/or use the Website as a guest or as a member (via a RAB Account).
    2. To apply for volunteering or mentoring opportunities with RAB and to access any of the third party information, materials, resources or seminars via the Website you may be required to create a RAB Account.
    3. You must be at least 18 years of age to create a RAB Account.
    4. You agree to maintain accurate, complete, and upto-date information in your RAB Account. Your failure to maintain accurate, complete, and upto-date account information, including but not limited to full name, contact details and credentials or registration details or past work experience/ history, may result in incorrect services provided to you by RAB. RAB may also temporarily or permanently suspend any account with inaccurate or false information from the Website, at RAB's discretion and without prior notice to you.   
    5. You are responsible for all activity that occurs under your RAB Account, and you agree to maintain the security and secrecy of your account username and password at all times. Unless otherwise permitted by RAB in writing, you may only possess one RAB Account.
    6. RAB reserves the right to either temporarily or permanently suspend or deactivate a RAB Account in the event of a breach of the Terms of Use or where you act in a way that is inappropriate, abusive or otherwise unacceptable towards any other users, third parties or Our staff or representatives, including but not limited to posting material that is false, inaccurate, misleading, deceptive, invasive of another person’s privacy, defamatory, libellous, hateful, racially biased or which a reader may reasonably find offensive, indecent or otherwise unlawful.
    7. By creating a RAB Account, you expressly consent and agree to accept and receive communications from Us, including via e-mail, text message, calls, and notifications to the telephone or mobile number you provided to us. You understand and agree that you may receive automated SMS or MMS messages or communications sent by or on behalf of RAB. Such communications may include, but are not limited to:
      1. communications in relation to any questions or feedback submitted by you to RAB;
      2. communications concerning your RAB Account or your use of the Website; and
      3. updates concerning new and existing features, news, communications and promotions.

  5. Legal Capacity
    1. You must be eighteen (18) years of age or over to use the Website.
    2. Any use of the Website is an acknowledgement by you that you:
      1. are over the age of eighteen (18) years;
      2. accept the Terms of Use; and
      3. agree that you have entered into a legal contract with RAB in relation to the Terms of Use.
    3. RAB reserves the right to take legal action and seek compensation from the parent or guardian of a minor for any loss or damage that RAB may suffer as a result of any action taken by a minor with a RAB Account.
  6. Your use of the Website
    1. You agree to use the Website only for purposes that are permitted by the Terms of Use, any applicable law or regulation and/or generally accepted practices or guidelines.
    2. You agree that you will not engage in any activity that interferes with or disrupts the Website or the servers and networks that host the Website. You agree not to, or attempt to, circumvent, disable or otherwise interfere with security-related features of the Website or features that prevent or restrict use or copying of any content or enforce limitations on the use of the Website or the content.
    3. You understand and agree that any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities, including but not limited to posting or transmitting material which contains software viruses, file or code designed to interrupt, destroy or limit the functionality of the Website or any other computer software or equipment.
    4. RAB may temporarily or permanently suspend access to the Website to you, or to guests or members generally, at its discretion and without prior notice to you.
    5. RAB may restrict your access to the Website, at Our discretion and without any prior notice to you. If RAB does this, you may be prevented from accessing all or parts of the Website or other details or content contained in your RAB Account. RAB will not be liable to you or any third party for doing so.
    6. As electronic websites are subject to interruption or breakdown, access to the Website is offered on an "as is" and "as available" basis only.
    7. For security, technical, maintenance, legal or regulatory reasons, or due to any breach of the Terms of Use, RAB may withdraw the Website, or change or remove website functionality at any time without notice to you.
  7. Intellectual Property Rights
    1. Unless otherwise indicated, the Intellectual Property on the Website is owned by RAB, and that the Intellectual Property remains the property of RAB and must not be used in any manner without the prior written consent of RAB. You acknowledge that the Intellectual Property is protected by Australian and international laws and nothing in the Terms of Use gives you a right to use any of the Intellectual Property.
    2. Nothing contained on the Website is to be interpreted as a recommendation to use any information on the Website in a manner which infringes the intellectual property rights of any person or third party. RAB makes no representations or warranties that your use of the information on the Website will not infringe such intellectual property rights.
    3. Your use of the Website is subject to the Copyright Act 1968 (Cth) and similar legislation. You may not in any form or by any means reproduce, modify, distribute, store, transmit, publish or display within another website or create derivative works from any part of the Website or commercialise any information obtained from any part of the Website without the prior written consent of RAB or, in the case of any third party material published on the Website, from the owner of the copyright in that third party material.
    4. You may not modify or copy the layout or appearance of the Website nor any computer software or code contained in the Website, nor may you decompile or disassemble, reverse engineer or otherwise attempt to discover or access any source code related to the Website.

Some parts of the Website may be interactive and allow you to post comments or allow you to correspond or otherwise communicate with RAB or other users, including but not limited to submitting or contributing images, texts and videos (Your Material). You automatically grant to RAB an irrevocable, perpetual, non-exclusive, royalty-free, world-wide licence to use, copy, display and distribute the content of Your Material and to prepare derivative works of the content or incorporate the content into other works in order to publish and promote such content, without any compensation or obligation to you. This may include, but is not limited to, publishing comments or testimonials on the Website and developing your ideas and suggestions for improved services or products.
    6. You warrant to RAB that any use by RAB of Your Material in accordance with the licences granted by you to RAB will not breach any third party's rights.
    7. RAB may edit, amend or remove any or all Your Material in its absolute discretion and without any notice to you.
  8. Other Websites
    1. The Website may contain links to other websites, which are owned or operated by third parties. These linked websites are not under RAB's control and RAB is not responsible for the operation, availability or contents of any linked website or any link contained in a linked website. RAB provides these links to you for convenience only and the inclusion of any link does not imply RAB's endorsement of the linked website. You access linked websites and third party content at your own risk. Subject to any non-excludable rights, RAB disclaims all warranties, express and implied, as to the accuracy, value, legality or otherwise of any materials or information contained on linked websites. You should carefully review the terms of use and privacy policies of all other third party websites that you visit.
    2. You agree that you will not post, link or otherwise publish any advertisements or promotional material for the services or products of any third parties or any spam or other forms of unsolicited communication on the Website.
    3. You agree that you will only link to the Website in a way that is fair and legal and does not damage RAB's reputation. You must not link, frame, refer to, or otherwise use the Website in a way which incorrectly suggests any form of association, approval or endorsement by us, or in a way which would be misleading or deceptive, or likely to mislead or deceive. RAB reserves the right to prevent you or any third parties from linking to the Website.
  9. Intellectual Property of Third Party

    10. Unless otherwise stated, RAB does not obtain or claim to obtain any ownership or exclusivity or intellectual property rights in relation to any third party resources.

  10. Secure Data and Transmissions
    1. Given the nature of the internet, RAB cannot guarantee that any data transmission is totally secure, free from viruses, fault or other conditions which could damage or interfere with your computer systems and RAB does not warrant that your access to the Website will be uninterrupted, error free or that any defects will be corrected. Whilst RAB takes precautions to protect information, RAB does not warrant and cannot ensure the security of any content or information you transmit via the Website. You therefore transmit to the Website at your own risk. However, once RAB receives your transmission, RAB will take reasonable steps to preserve its security.     12. By using the Website, you consent to RAB using cookies to gather data in relation to the Website. You may be able to disable cookies on your web browser, but if you do you may not be able to fully utilise all the features of the Website.

  12. Use of your information and material

    13. RAB appreciates any suggestions (“Unsolicited Ideas”) you may have regarding ways in which the Website may be improved or materials which may be added to the Website. Any Unsolicited Ideas that you submit will not be regarded as confidential and will become the property of RAB. RAB may use, reproduce, disclose, publish, modify, adapt and transmit them to others, without restriction or any obligation to compensate you.

  13. RAB Privacy Policy

    14. The RAB Privacy Policy available on the Website https://www.radiologyacrossborders.org/privacy-policy explains how your personal information is collected and managed in accordance with the Australian Privacy Principles in the Privacy Act 1988 (Cth) and any other legislation, principles, industry codes and policies relating to the collection, use, disclosure, storage or granting of access rights to personal information.

  14. Disclaimer, Liability and Indemnity
    1. THE LIMITATIONS AND DISCLAIMER IN THIS SECTION DO NOT PURPORT TO LIMIT LIABILITY OR ALTER YOUR RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
    2. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAB MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, IN RELATION TO ANY INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED IN THE WEBSITE OR TO ITS AVAILABILITY, FUNCTIONALITY OR PERFORMANCE, EXCEPT AS OTHERWISE PROVIDED UNDER ANY APPLICABLE LAW. YOU AGREE THAT THE ENTIRE RISK ARISING OUT OF ANY INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED IN THE WEBSITE OR TO ITS AVAILABILITY, REMAINS SOLELY WITH YOU, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.

    4. RAB SHALL NOT BE LIABLE FOR DELAY OR FAILURE IN PERFORMANCE WITH THE WEBSITE RESULTING FROM CAUSES BEYOND RAB'S REASONABLE CONTROL.
    5. IF ANY LIABILITY IS NOT ABLE TO BE EXCLUDED BY LAW, RAB LIMITS OUR LIABILITY TO THE RE-SUPPLY OF THE RELEVANT INFORMATION OR SERVICES.
    6. You agree to indemnify RAB from all damages, losses, penalties, fines, expenses and costs (including legal costs) which arise out of or relate to any one or more of the following:
      1. your use of the Website which is in breach of or in any way contrary to the Terms of Use;
      2. your inappropriate or illegal use of the Website;
      3. any information that you provide via the Website (including but not limited to misleading, false or inaccurate information);
      4. any other breach of the Terms of Use or Additional Terms or other policies of RAB;
      5. your violation of any applicable law, rule or regulation;
      6. your negligence or wilful misconduct; or
      7. any damage that you may cause to the Website.

    This indemnification includes, without limitation, liability relating to copyright infringement, defamation, invasion of privacy and trade mark infringement.

  15. Social Media
    1. RAB may operate accounts on third party social media platforms at any time, including but not limited to YouTube, LinkedIn, Facebook, Instagram and Twitter (RAB Social Media Accounts). Where applicable, your use of any RAB Social Media Accounts will be subject to the Terms of Use.
    2. Without limiting anything in the Terms of Use, the following additional terms are applicable for your use of any RAB Social Media Accounts:
      1. Appropriate Use

          You agree to comply with the following guidelines when using any RAB Social Media Accounts:

        1. You agree that you are responsible for any content that you submit to RAB Social Media Accounts, including comments, photographs or any other media format.
        2. You agree:
          1. not to post advertisements;
          2. not to post any false or misleading information;
          3. not to upload any computer programs or files, including but not limited to any malicious code or viruses which may interfere with the operation or use of the RAB Social Media Accounts;
          4. not to post any inappropriate material that could reasonably be deemed as defamatory, offensive or obscene; and
          5. not to use the online space for illegal purposes or to breach any applicable law, rule or regulation, including but not limited to anything which may violate the rights of a third party such as copyright, trademark and/or privacy rights.
      2. Comments posted by users not endorsed by RAB
        1. RAB does not in any way represent that RAB recommends or endorses any comments, statements or opinions expressed in posted by any users or members on any RAB Social Media Accounts.
        2. Any comments, statements or opinions expressed in any online posts by any user or member on any RAB Social Media Accounts, is the view and responsibility of that user or member. RAB does not accept any responsibility or liability in connection with any comments, statements or opinions expressed by any user or member on any RAB Social Media Accounts.
      3. Comment moderation and disclosure by RAB
        1. Whilst RAB has no obligation to monitor any RAB Social Media Accounts, RAB reserves the right from time to time to monitor any and all information transmitted or received through any RAB Social Media Accounts for any purpose.
        2. RAB reserves the right at any time to disclose any information posted by a user or member on any RAB Social Media Account as necessary to satisfy any law, rule or regulation.
        3. The use of any RAB Social Media Accounts constitutes consent to any moderation or disclosure by RAB.
        4. RAB reserves the right to remove any comments or posts made by a user or member on any RAB Social Media Account. RAB also reserves the right to restrict any user or member who fails to follow the Terms of Use. 
      4. Privacy

    The use of any RAB Social Media Accounts is subject to the RAB Privacy Policy.

  16. Governing Law and Jurisdiction
    1. The Terms of Use are governed by and construed in accordance with the laws of New South Wales, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
    2. If you access the Website in a jurisdiction other than New South Wales, Australia, you are responsible for compliance with the laws of that jurisdiction, to the extent that they apply. RAB makes no representations that the content of the Website complies with the laws of any country outside Australia. You access the Website entirely at your own risk. RAB does not accept any responsibility or liability in connection with any non-compliance with the laws of any country outside Australia.
  17. General
    1. If any provision of the Terms of Use is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Terms of Use, which will continue in full force and effect.
    2. The failure by RAB to exercise or enforce any right or provision under the Terms of Use will not constitute a waiver of such right or provision. Any waiver of any provision under the Terms of Use will only be effective if it is in writing and signed by RAB.
    3. The Terms of Use may be amended at any time without notice and your access to the Website may be terminated at any time without notice. Your continued use of the Website following such amendment of the Terms of Use will represent an agreement by you to be bound by the Terms of Use as amended. Where your access to the Website is terminated, all disclaimers and limitations of liability set out in the Terms of Use will survive.
